RULES OF THE bbhome.pl ONLINE STORE

I. General provisions.

  1. These "Regulations of the Online Store BBHOME.PL (hereinafter referred to as "Rules") Defines the rules for making purchases in the online store available at www.bbhome.pl (hereinafter referred to as"The store"), In particular the rules and procedure for concluding distance sales contracts via the Store. These Regulations define in particular:
    1) rules for registering and using the account as part of the online store;
    2) terms and conditions for making electronic reservations of products available as part of the online store;
    3) the terms and conditions for submitting Orders via the online store;
    4) rules for concluding Sales Agreements with the use of services provided as part of the Online Store.
  2. The store is run by: BBHome Sp. z o. o. sp.k. with its seat in Warsaw (address: ul. Nasienna 9, 02-241 Warsaw), a company entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 0000596176th Commercial Division of the National Court Register under number 9512404053, NIP numbers 363499314 and Regon XNUMX, e-mail address: online@bbhome.pl (hereinafter referred to as "Dealer").
  3. The website www.bbhome.pl offers furniture and interior decoration items that are the property of the Seller.
  4. Viewing the Store's assortment does not require creating an Account. Placing Orders is possible either after creating an Account in accordance with the provisions of point III of the Regulations or by providing the necessary personal and address data enabling the Order to be completed without creating an Account.

II. Definitions.

The words or phrases used in the Regulations, written with capital letters, mean:

  1. Klient - a natural person with full legal capacity, a legal person or an organizational unit without legal personality, which separate provisions grant legal capacity, making purchases in the Store on the terms set out in the Regulations;
  2. Entrepreneur - a natural person who is not a Consumer, a legal person and an organizational unit that is not a legal person, to which a separate act grants legal capacity, conducting business or professional activity on its own behalf;
  3. Consumer - a natural person who performs a legal transaction with the Seller not directly related to its business or professional activity; other persons who, in given circumstances, require the treatment of consumers as consumers, are considered to be a consumer to the extent specified by these legal provisions;
  4. Products - furniture and interior design items offered for sale in the Store, which are the property of the Seller;
  5. Order - the Customer's declaration of will submitted via the Order Form on the Store's website and aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and number of Products purchased;
  6. Account - Customer's account in the Store, enabling the Customer to make purchases in the Store, in which, among others, the data provided by the Customer and information about the Orders placed by him are collected; setting up an Account is free of charge;
  7. Registration Form - a form available on the Store's website, enabling the creation of an Account while placing an Order;
  8. The order form - an interactive form available on the Store's website that allows placing an Order, in particular by adding Products to the Cart and defining certain terms of the Sales Agreement, in particular the method of delivery and payment;
  9. Basket - an element of the Store, in which the Products selected by the Customer are visible and in which the Customer has the option to determine and modify the Order data, in particular the quantity of Products purchased;
  10. Sales agreement - Product sales contract concluded or concluded between the Customer and the Seller using the Store;
  11. Working days - all days from Monday to Friday inclusive, except for public holidays in Poland;
  12. Civil Code - Act of April 23, 1964 - Civil Code (i.e. Journal of Laws of 2020, item 1740, as amended).

III. Technical requirements.

  1. To use the Store it is necessary:
    a) having an active e-mail account by you,
    b) having a terminal device with access to the Internet and a web browser such as Mozilla Firefox, Chrome, Opera or Internet Explorer 11 (or newer) with enabled Java, JavaScript and Cookies applets,
    c) the minimum screen resolution of the end device with Internet access is 1024 × 768 pixels, and 1280 × 800 pixels is recommended.
  2. To set up an Account in the Store, you must complete the Registration Form. It is necessary to provide the following data:
    d) name and surname,
    e) name (in the case of Entrepreneurs),
    f) address of residence (or registered office of the Entrepreneur),
    g) e-mail address,
    h) telephone number
    i) tax identification number (NIP) for Entrepreneurs.
  3. Logging in to the Account is done by entering the login and password set by the Customer in the Registration Form.
  4. The Customer may at any time request the deletion of his Account by sending a relevant request to the Seller via e-mail or in writing to the addresses provided in point. I.2 above.
  5. If the technical requirements of your browser are not met, the Store will inform you about it with a separate message after entering the Store's website, at the same time informing you about the need to install the appropriate browser or update it.
  6. The use of services provided via the web requires basic information about your computer, such as: IP address, domain, address of the previously visited website, the browser you use and the operating system, etc.
  7. The Seller is not responsible for any disruptions, including interruptions in the functioning of the Store, caused by force majeure, unauthorized actions of third parties or the Store's incompatibility with the Customer's technical infrastructure.

IV. Rules for using the Online Store.

  1. The Seller may deprive the Customer of the right to use the Store, and may limit his access to some or all of the Store's resources with immediate effect in the event of a breach of the Regulations by the Customer, in particular when the Customer:
    1) during registration in the Store provided false, inaccurate or out-of-date data, misleading or infringing the rights of third parties,
    2) commits other behaviors, contrary to the law or the principles of social coexistence.
    A person who has been deprived of the right to use the Store's website may not re-place an Order or create an Account without the prior consent of the Seller.
  2. In order to ensure the security of the transmission of messages and data in connection with the services provided as part of the Store, the Seller provides standard technical and organizational measures appropriate to the degree of threat to the security of the services provided, in particular measures to prevent the acquisition and modification of personal data sent on the Internet by unauthorized persons.
  3. The customer is obliged in particular to:
    1) use the Store in a way that does not interfere with its functioning, in particular through the use of specific software or devices,
    2) to use any content contained in the Store only for personal use,
    3) use the Store in a manner consistent with the provisions of the law on the territory of the Republic of Poland, the provisions of the Regulations, as well as the general principles of using the Internet.

V. Conclusion of the Sales Agreement.

  1. In order to conclude a Sales Agreement using the Store, go to the website https://bbhome.pl, select a Product from the Store's offer, taking further technical steps based on the messages displayed to the Customer and information available on the website and sent by e-mail from the address skleponline@bbhome.pl. On the website www.bbhome.pl, Sales Agreements are concluded in Polish.
  2. The selection of the Products ordered by the Customer is made by adding them to the so-called Cart.
  3. When submitting the Order - until the button "Buy and pay" is pressed - the Customer may modify the entered data and the selected Product. To do this, follow the messages displayed to the Customer and the information available on the website.
  4. After the Customer using the Store provides all the necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will contain information on:
    1) the subject of the Order,
    2) prices of the Ordered Products, including delivery costs and additional costs (if any),
    3) selected payment method and payment date,
    4) selected delivery method,
    5) delivery time.
  5. In order to place an Order:
    a) select the Product that is the subject of the Order, and then click the "Add to Cart" button;
    b) then go to the so-called "Basket" by clicking the "View basket" button;
    c) then go to the so-called "Checkout" by clicking the "Proceed to Checkout" button or by selecting ApplePay payment options and clicking the appropriate button;
    d) fill in the Order Form by entering the details of the recipient of the Order and the e-mail address to which the purchase confirmation is to be made, enter the invoice details, if different from the details of the recipient of the Order, select one of the available payment and delivery methods and click the "Buy and pay" button ,
    e) pay for the Order in accordance with the selected payment method.
  6. We confirm the placement of the Order by e-mail immediately after sending the Order. The conclusion of a binding Sales Agreement takes place when you receive confirmation of the Order being accepted for execution. Please note that the Products ordered by you will be shipped after you pay for their full price and delivery costs.
  7. The condition for placing an Order, creating an Account or concluding a Sales Agreement is consent to the content of the Regulations and providing personal data that the Online Store may process in order to perform the Order and perform the Sales Agreement.
  8. Orders placed and unpaid by the Customer are canceled and removed from the Store's system after 30 days from the date of placing the Order.
  9. In the event of unavailability of some of the Products covered by the Order, the Seller will contact the Customer, who will decide on the method of further action, including partial execution of the Order, extension of the delivery time, and cancellation of the Order.

VI. Product prices. Product Ownership Reservation.

  1. Product prices are given on the Store's website. The applicable prices for Products are the prices indicated on the Store's website at the time of placing your Order.
  2. The prices of the Products indicated on the Store's website include VAT in the amount specified by law.
  3. Information about the Products provided on the Store's websites, in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a Sales Agreement within the meaning of art. 71 of the Civil Code.
  4. The ownership of a given Product becomes the property of the Customer upon its release to the Customer, but not earlier than upon payment of the Product price referred to in point VI.1 above.

VII. Payment.

  1. Payment for the ordered Product is possible in one of the following types of payment:
    1) by bank transfer to the Seller's bank account number: 68 1090 1870 0000 0001 3283 3600,
    2) payment in the Przelewy24.pl, PayU system,
    3) payment by payment card via Stripe (the credit card is charged at the time of placing the Order),
    4) in cash upon personal collection in the main warehouse at ul. Nasienna 9, 02-241 Warsaw, from 10-17 on Working Days,
    5) by purchasing products in installments. Detailed information on concluding the loan can be found on the website of the installment payment operator - PayU.pl.
  2. For each Order, we reserve the right not to offer certain types of payment and to offer others.
  3. Only payments from bank accounts within the European Union (EU) are accepted.
  4. You bear all costs of financial transactions.
  5. In the case of a purchase using a credit card, the credit card account is debited upon placing the Order.

VIII. Delivery of Products and its costs.

  1. The delivery of Products is limited to the territory of the Republic of Poland and takes place at the address indicated by the Customer when placing the Order.
  2. The purchased Products are delivered by courier. The delivery costs are indicated on the website: https://bbhome.pl/dostawa-i-zwrot/ In addition, the delivery costs will be indicated when placing the Order. In the case of a special delivery, delivery costs are not indicated when placing the order, they are determined immediately after placing the Order by e-mail or telephone.
  3. The deadline for the delivery of the purchased Products is from 2 Business Days to 8 weeks from the date the payment for the purchased Products is credited to the Seller's account.
  4. The customer is obliged to pick up the purchased Product.
  5. Together with the delivered Product, the Customer receives an invoice or a fiscal receipt, which confirms the conclusion of the Distance Sale Agreement.
  6. Storage costs are covered by BBHome within 5 days of notifying the Customer. A fee of PLN 50 will be charged for each subsequent day.

IX. The statutory right to withdraw from the Product Sales Agreement.

  1. Subject to the provisions of point IX.2 below, if you are a Consumer, you have the statutory right to withdraw from the Sales Agreement, the above provision also applies to a natural person concluding a Sales Agreement directly related to its business, if the content of this contract it follows that it does not have a professional character for this person, resulting in particular from the subject of the business activity it carries out, made available on the basis of the provisions on the Central Register and Information on Economic Activity.
  2. You do not have the right to withdraw from the Sales Agreement in relation to contracts:
    1) in which the subject of the service is a non-prefabricated item, manufactured according to the Consumer's specification or serving to satisfy his individual needs,
    2) in which the subject of the service is a Product that deteriorates quickly or has a short shelf life,
    3) in which the subject of the service is a Product delivered in a sealed package, which after opening the package cannot be returned due to health protection or hygiene reasons, if the package was opened after delivery,
    4) in which the subject of the service are items that after delivery, due to their nature, remain inseparably connected with other items,
    5) in which the subject of the service are sound or visual recordings or computer software delivered in a sealed package, if the package has been opened after delivery,
    6) for the delivery of newspapers, periodicals or magazines, with the exception of a subscription agreement,
  3. If you want to exercise your right to withdraw from the Sales Agreement, you can use the withdrawal form, but it is not mandatory, available for printing on the Store's website. Please help us avoid additional costs and always send returned Products with a completed and signed withdrawal form.
  4. You have the right to withdraw from the Sales Agreement within fourteen days, without giving reasons. The deadline for withdrawing from the contract runs from the date on which you acquire the sold Product, however, in the case of a Sales Agreement that includes many Products that are delivered separately, in batches or in parts - this period runs from taking possession of the Product sold. the last item, batch or part of the Products covered by this contract. In order to exercise your right to withdraw from the Sales Agreement, you must submit a statement to the Seller. In order to exercise the right to withdraw from the contract of sale, a statement on the exercise of this right should be sent before the deadline for withdrawal indicated above.
  5. In the event of your withdrawal from the Sales Agreement, such Agreement shall be deemed not concluded. If you submitted a declaration of withdrawal from the Sales Agreement before the Seller accepted his offer, this offer ceases to be binding.
  6. In the event of your withdrawal from the Sales Agreement, the Seller is obliged to immediately, no later than within 14 days from the date of receipt of the declaration of withdrawal from the agreement, return all payments made by you, including the costs of delivering the Product. The seller will refund the payment using the same method of payment as you used, unless you have expressly agreed to a different method of reimbursement, which does not involve any costs for you. The Seller may withhold the reimbursement of payments received from you until you receive the Product back or you provide proof of its return to the Seller, whichever occurs first. If you have chosen a delivery method other than the cheapest standard delivery method offered by the Seller, the Seller is not obliged to reimburse you for any additional costs incurred by the Seller.
  7. In the event of withdrawal from the Sales Agreement, you are obliged to return the received Product to the Seller (to the following address: BBHome Sp. Z oo sp.k., Warehouse, Nasienna 9, 02-241 Warsaw) or hand it over to a person authorized by the Seller for collection immediately, however, no later than 14 days from the date on which you withdrew from the Sales Agreement. To meet the deadline, it is enough to return the items before its expiry. In this regard, you only bear the direct costs of returning the Product. If the Product was delivered to you to the place where you resided at the time of concluding the Sales Agreement, the Seller is obliged to collect the Product at his own expense, if due to the nature of the Product it cannot be returned by regular mail.
  8. In the event of withdrawal from the Sales Agreement, you are responsible for the decrease in the value of the Product as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the item.

X. Statutory liability for product defects. Complaints.

  1. We commit ourselves to the entrepreneur's liability provided for by law for the compliance of the service with the contract
  2. In the event of any defects in the Products, we are legally liable under the warranty for defects, resulting from art. 556 and following of the Act of 23 April 1964 - Civil Code (Journal of Laws 2016.380 as amended).
  3. All reports of defects in Products purchased in our Store, as well as the course of the implementation of your Order (hereinafter "Complaints Policy”) should be submitted to us by e-mail to the address online@bbhome.pl. In the same way, you can report any problems with the collection of the return shipment by the courier. In some cases, we may ask you to send us photos of the Products subject to the complaint. In the complaint, you should provide your name (or company), full postal address and, if available, telephone number and e-mail address, type and date of occurrence of the defect.
  4. Each complaint will be considered by us within 14 days from the date of its receipt. We will immediately notify you of any missing complaints. Along with such notification, you will be sent information on how to supplement the deficiencies in the complaint.
  5. We would also like to inform you that you have the option of using extrajudicial means of dealing with complaints and redress.
  6. Consumers, apart from the possibility of pursuing their claims in court, have the right to use out-of-court complaint and redress procedures. The rules on the possibility of exercising these claims and access to procedures are available at the offices and on the websites of poviat / city consumer ombudsmen, Voivodeship Inspectorates of the Trade Inspection and social organizations whose statutory task is to protect Consumers. In addition, information is available at the website of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php.
  7. In particular, the Consumer has the right to:
    a) turn to a permanent consumer arbitration court referred to in art. 37 of the Act of 15 December 2000 on the Trade Inspection (i.e. Journal of Laws of 2020, item 1706, as amended), with a request to settle a dispute arising from the concluded sales contract;
    b) apply to the provincial inspector of Trade Inspection, pursuant to art. 36 of the Act of December 15, 2000 on the Trade Inspection (i.e. Journal of Laws of 2020, item 1706, as amended), with a request to initiate mediation proceedings for the amicable settlement of the dispute;
    c) apply to the poviat / municipal consumer ombudsman or one of the social organizations whose statutory task is to protect consumers.
  8. The register of entities competent to conduct the proceedings is kept by the President of the Office of Competition and Consumer Protection and is available on the website of the Office of Competition and Consumer Protection, available at: https://uokik.gov.pl/rejestr_podmiot_uprawnionych.php.
  9. The consumer may also use the online dispute resolution system between consumers and entrepreneurs at the EU level (ODR platform available at: http://ec.europa.eu/consumers/odr/). The ODR platform is an interactive and multilingual website on which the consumer and the entrepreneur have access to comprehensive services regarding the out-of-court settlement of a dispute regarding contractual obligations arising from an online sales contract or a contract for the provision of services.

XI. Additional information.

  1. These Regulations can be found on the Store's website. You can print or save the regulations using the usual functions of your web browser (most often: File -> Save As). You can also download this document in PDF format and archive it. In order to open the PDF file you need the free Adobe Reader program (available on the website www.adobe.pl) or another similar program that opens PDF files.
  2. The Seller reserves the right to amend the Regulations. The Seller will inform the Customer about each change at least 7 days in advance.
  3. In matters not covered by the Regulations, generally applicable provisions of Polish law shall apply, in particular: the Civil Code and the Act of May 30, 2014 on consumer rights (i.e. Journal of Laws of 2020, item 287 as amended).
